Chicopee Retirement Board approves firefighter's ordinary disability, denies police accidental claim

The Chicopee Retirement Board on March 25 approved an ordinary disability retirement for firefighter Jason Furr and denied an accidental disability claim under a "heart presumption" for police officer Christopher Malooly, while subsequently approving Malooly's ordinary disability.
Board members voted in executive session under M.G.L. Chapter 30A Section 21 to review medical panels and the physical condition of two individuals. After reviewing medical reports and statutory provisions, the board moved to approve Furr's ordinary disability retirement and to send the approval to the state Public Employee Retirement Administration Commission (PERAC) for final action. The motion was made by David Ference and seconded by Tiana Steffenhagen; roll-call votes were recorded as "Yes" from all members.
The board next considered Malooly's request for an accidental disability under a heart presumption (referred to in the minutes as "94"). Following discussion and review of supporting reports, the board denied the accidental-disability request by roll call. The board then approved Malooly's ordinary disability retirement and agreed to forward that approval to PERAC; that motion passed on a roll-call vote.
All roll-call votes recorded at the March 25 meeting were unanimous among the five voting members. The board noted it will submit the approved ordinary disability cases to PERAC for final determination.
