Planning commission denies site plan for 543 Walnut Street, moves to review levy-overlay rules

The Lawrenceburg City Planning Commission on an unaniminous vote denied the Incompass site plan for 543 Walnut Street after a debate over safety, traffic and how the city's "levy overlay" affects rezoning.

Attorney Dell Weldon told the commission that "any official action requires a majority vote of the entire planning commission," explaining that a seven-member commission needs four affirmative votes for either approval or rejection. He said a tie is not a rejection but a non-action that leaves an application tabled.

Commission debate centered on the levy overlay district. Commissioners questioned staff's interpretation that the overlay allows "every use in the city" within its boundaries and therefore can permit conversions that otherwise might go to the Board of Zoning Appeals. One commissioner framed the decision in local terms, arguing the area should remain commercial because of "safety, traffic flow," and moved to deny the site plan; the motion was seconded and the denial passed unanimously.

After the vote, commissioners agreed the overlay and other parts of the UDO warrant revision. Staff said the city will reopen work on the Unified Development Ordinance, form a subcommittee of commissioners to draft a proposed ordinance to remove the levy overlay district, and engage the Planning Commission and City Council in a more deliberate rewrite.

The commission did not record a numeric roll-call tally in the transcript, but recorded that the motion "passes" and was "unanimous." Attorney Dell Weldon had also emphasized that if the commission formally rejects an application it must state reasons; if it approves an application it adopts the applicant's proposed reasoning.

Next steps: staff will begin UDO work with a subcommittee of commissioners; the denied site plan remains tabled until a future filing or rehearing if the applicant pursues further action.
