Engineer proposes large mitigation for after-the-fact deck at 15 Beach Street; staff resists expedited compliance

Chuck Rowland of Cape and Islands Engineering presented plans for 15 Beach Street, where an after-the-fact deck and associated hardscape were discovered during file review of a long-open certificate of compliance from 1986. Rowland said the filing includes both restoration and mitigation measures to correct historic omissions and support a clean title transfer for the property.
"The applicant proposes to install approximately 2,199 square feet of native plantings to mitigate for the enlarged deck," Rowland said, adding that the proposal also includes roughly 2,960 square feet of vista-corridor restoration and requests for irrigation and an on-site preconstruction meeting.
Staff questioned an applicant request for an expedited certificate of compliance tied to a pending real-estate closing. "Staff cannot support issuing an expedited COC in this circumstance, especially given the amount of plantings that are being put in at this time," Fallon said. Staff recommended a site visit to confirm staking and planting locations and advised that plantings be established before any certificate is issued.
Prospective buyer Laura Scott addressed the commission noting the COC was important to closing and asked for as much accommodation as possible once plantings are complete. Staff reiterated the commission’s role to ensure mitigation is installed and monitored; commissioners emphasized a short site-visit and follow-up with photos. The commission voted to issue an order of conditions and close the hearing with staff-directed conditions; a formal expedited COC was not supported by staff at the meeting.
Next steps: staff will confirm mitigation staking and supply photos; applicants may return to request a certificate of compliance once restoration is established.
