Byron council adopts charter amendment to join Mid-State Energy Commission for joint natural gas services

The City of Byron on Dec. 14 approved a charter amendment (Ordinance #2020-8) and a companion intergovernmental operating agreement to allow Byron to participate in a regional Mid-State Energy Commission that will manage jointly owned natural gas services with Cochran, Hawkinsville, Perry and Warner Robins.
Mayor Michael Chidester presided as council took the ordinance through a third reading and a second adoption; Council Member Michael Chumbley moved adoption, and Council Member Rusty Adams seconded. The council approved the ordinance and the resolution to enter the intergovernmental agreement unanimously.
According to the minutes, the action updates the cities’ joint activities under the partnership known as Jointly Owned Natural Gas (JONG) and relies on the authorization in the Georgia Constitution (Article IX, Section III, Paragraph 1(a)) that permits cities to contract with one another for shared use of facilities and operation of utilities for up to 50 years. The resolution authorizes Byron’s participation in the new Mid-State Energy Commission and its ability to enter into the intergovernmental operating agreement with the partner cities.
Council did not record any formal dissent or separate amendments to the ordinance in the minutes. The council resolution and the ordinance are filed in the City Clerk’s office at the Municipal Complex.
