The Village of Amityville Zoning Board of Appeals on Jan. 22 unanimously approved a variance allowing Timothy Eyring to maintain a 6‑foot vinyl fence at 133 County Line Road.
Eyring told the board he bought the house five months ago and ‘‘began installing a white 6‑foot PVC fence not knowing he needed approval and a permit to do so,’’ and said he needs the fence to keep his dog from getting out of the yard. No members of the public spoke in opposition.
The board approved the variance under Section 183‑139 A(3) of the Village Code on a 5–0 vote (motion by Vice Chair Eric Taylor; second by Timothy McManus). Stipulations attached to the approval require Eyring to secure a fence permit, conform to the plans filed with the application, ensure the ‘‘good’’ side of the fence faces outward, and comply with applicable State, Village and local codes. Chair Tracey Cullen reminded applicants that ‘‘all agreed upon concessions, promises, pledges, assurance, or declarations given by them or their duly appointed agents, during their hearing process shall become stipulations to any approvals given by the Board.’’
Next steps: Eyring must obtain the required fence permit before the work is finalized and must follow the approved plans.
