Midway council approves documents to preserve Lundin property as open space

Corbin Gordon, Midway city attorney, presented the documents the council reviewed, saying the package included a conservation easement purchase agreement, a conservation easement, a trail and access easement agreement, an escrow agreement, a security agreement and a water share agreement. Gordon said the one remaining item was the deed requirements tied to the Natural Resources Conservation Service: "Still needed the deed requirements for the Natural Resources Conservation Service." He recommended the council approve the documents subject to his checking that all exhibits were included and correct.
Mayor Craig Simons confirmed no substantive changes had been made since the documents were last discussed and described finalizing the land as open space as "a long time coming," thanking John Woodard of the Wasatch County Attorney’s office, Wendy Fisher of Utah Open Lands, the Lundin family and others involved in the preservation project.
Council Member Lisa Orme moved to accept and approve the listed documents with conditions authorizing the mayor to sign the conservation easement and related instruments, subject to Wasatch County approval and the city attorney’s final exhibit checks, and to authorize a check to the Lundin family; Council Member Andy Garland seconded. The motion passed with Garland, Orme, Osborne and Simonsen voting in favor; Council Member Kevin Payne was excused.
