Montgomery County approves conditional funding agreement for Jackson Hospital; chairman abstains

The Montgomery County Commission on Feb. 10 approved an agreement to provide funding to Jackson Hospital intended to shore up operations as the hospital navigates bankruptcy proceedings.

Kindell Anderson, the county administrator, presented the agreement to the commission and described its basic terms: the county would make an initial payment of $10,000,000 after receiving required documentation and invoices, and up to $7,500,000 more would be paid in increments over a three‑year period beginning in 2027, for a total stated funding commitment of $17,500,000.

The agreement appended to the meeting minutes references a Jan. 5, 2026 bankruptcy court order in the Middle District of Alabama (In re: Jackson Hospital & Clinic, Inc., Docket No. 25‑30256, Doc. 1319) that limits how the funding may be used. The agreement explicitly provides that county funds “may not be used to repay, satisfy, or otherwise address any indebtedness incurred by Jackson Hospital prior to November 1, 2025,” and it bars use of the funds to pay creditors or professional fees identified in the bankruptcy proceeding.

The agreement establishes several conditions the hospital must meet before or while funding is delivered: consent to annual financial audits (paid by the hospital), provision of detailed monthly invoices and reports by the 10th of each month showing use and allocation of funds, and timely payment of local tax obligations. The county may terminate the agreement if the hospital or the other parties fail to meet terms, or if the State of Alabama or the City of Montgomery do not provide equitable funding in a timely manner.

Commissioner Justin M. Castanza moved to approve the agreement and Commissioner Sankey seconded. The motion carried, with Chairman Doug Singleton recorded as abstaining on the action in the minutes. The minutes do not record a roll‑call of individual yes or no votes beyond naming the abstention.

The agreement’s memo states the county’s intent is to ensure continuity of healthcare services for Montgomery residents and central Alabama if Jackson Hospital otherwise closes; the appended agreement also warns that closure would place additional burdens on other local hospitals already affected by Jackson Hospital’s financial decline.

The commission did not record direct quotes from hospital officials in the minutes. The agreement and its required documentation set conditions and reporting requirements that county officials said would be monitored going forward. The agreement will be executed consistent with the terms in the appended contract and is contingent on the hospital’s compliance with the court order and the other conditions outlined in the document.
