Bardstown council adopts ordinance establishing building and electrical inspection program
Summary
At a special teleconference Aug. 15, the Bardstown City Council unanimously adopted Ordinance B2024-11 to require permits, inspections and certificates of occupancy under the Kentucky Building and Residential Codes and to create fee schedules and authority to hire a building and electrical inspector.
The Bardstown City Council adopted Ordinance B2024-11 during a special teleconference session on Aug. 15, 2024, voting 6-0 to establish a city building and electrical inspection program, permit requirements and a schedule of fees to cover the program’s costs.
City Attorney Audrey Haydon read the ordinance summary on second reading, citing state regulations 815 KAR 7:120 (Kentucky Building Code) and 815 KAR 7:125 (Kentucky Residential Code) and noting that KRS 198B.060(1) requires new construction to comply with the state’s uniform building code. The ordinance authorizes the city to hire a building and electrical inspector, require permits and certificates of occupancy, and adopt a fee schedule to recover program costs. The ordinance text states: "AN ORDINANCE RELATING TO 815 KAR 7:120 KENTUCKY BUILDING CODE AND 815 KAR 7:125 KENTUCKY RESIDENTIAL CODE, AS ADOPTED BY THE DEPARTMENT OF HOUSING, BUILDINGS AND CONSTRUCTION OF THE COMMONWEALTH OF KENTUCKY."
The attachments to the ordinance set out specific procedures and fees. Attachment A gives the Building & Electrical Inspector authority to establish permit forms and fees with City Council approval, requires a minimum of three site inspections and written reports for covered work, and requires payment of fees before permits are issued; it further instructs that the Historic Resources Board must be notified for work in the Bardstown Historic District. Attachment B describes plan-review fee methodology including a fast-track surcharge (50 percent, with a minimum additional fee noted) and a $300 minimum review fee for new construction and many plan reviews. Attachment C lists electrical permit fees with sample charges (for example, single-family up to 3,000 sq. ft.: $150 for three inspections; generator or solar installations: $50) and a $50 re-inspection fee; it also lists application requirements including proof of insurance and licensing and provides a scheduling phone number, (502) 348-5947. Attachments D and E provide the building permit fee tables (cost-per-square-foot multipliers and minimums) and mechanical/HVAC fee examples (typical single-family system: $105; re/failed inspections: $100).
Councilman David Dones moved to adopt the ordinance; Councilwoman Betty Hart seconded. The mayor called the roll and the following voted aye: Councilman Joe Buckman, Councilman David Dones, Councilwoman Betty Hart, Councilman Franklin Hibbs IV, Councilman Bill Sheckles and Councilman Roland E. Williams. Mayor J. Richard Heaton declared Ordinance No. B2024-11 adopted. The ordinance will be recorded in Ordinance Book No. 11 as required by city procedure and is effective following passage and publication as provided by law.
Councilman Roland E. Williams moved to adjourn at 12:03 PM; Councilman Franklin Hibbs IV seconded the motion, which carried 6-0.
