Morton County Commission approves three special assessment districts, hears budget and land-use items

The Morton County Commission on July 8 approved three special assessment districts, accepted a final plat and zoning amendment for a new subdivision and authorized a juvenile detention agreement, while also hearing a budget presentation from the local health district.
Chairman Ronald Leingang called the meeting to order at 5:30 p.m. and Commissioners Zachmeier, Boehm and Morrell were recorded as present; Commissioner Buckley joined the meeting virtually later. The commission first approved its agenda, the minutes of June 22 (with a correction) and bills and payroll by unanimous votes of those present.
Debbie Lafferty provided an update and submitted a 2022 budget request for the Morton County Council on Aging, and Brent Ekstrom gave an update on the Lewis & Clark Regional Development Group. Erin Ourada, identified as Custer Health Administrator, presented the Custer Health 2022 budget at 7:00 p.m.; Leingang opened and closed the public hearing on that budget between 7:00 and 7:03 p.m. The transcript records no public testimony during the budget hearing.
The commission held and closed three consecutive public hearings for proposed special assessment districts. Chairman Leingang opened the Rock Haven Harbor hearing at 6:00 p.m. and closed it at 6:03 p.m.; he opened the Zachmeier Flats hearing at 6:03 p.m. and closed it at 6:38 p.m.; and he opened the Entzel Acres hearing at 6:38 p.m. and closed it at 6:47 p.m. The transcript shows no public comments during those hearings.
After the hearings, commissioners voted to approve the three special assessment districts. Commissioner Boehm moved and Commissioner Morrell seconded approval of Special Assessment District No. 2187 (Rock Haven Harbor); voting aye were Boehm, Morrell and Leingang and the motion carried. Commissioner Morrell moved and Commissioner Boehm seconded approval of Special Assessment District No. 2188 (Zachmeier Flats); voting aye were Morrell, Boehm and Leingang and the motion carried. Commissioner Boehm moved and Commissioner Morrell seconded approval of Special Assessment District No. 2189 (Entzel Acres); voting aye were Boehm, Morrell and Leingang and the motion carried. Commissioner Zachmeier was recorded as recused from the special assessment items due to a conflict of interest.
Later in the meeting, with Commissioner Buckley present, Commissioner Zachmeier moved and Commissioner Boehm seconded approval of the final plat of Jared Subdivision and a zoning map amendment from Agricultural to Residential. The commission found the subdivision conforms to Article 7 of the Morton County Land Use Code and is consistent with Policy 1.1.2(g) of the Morton County Comprehensive Plan; the motion carried with all voting aye.
Commissioner Boehm moved and Commissioner Morrell seconded to approve the Juvenile Detention Agreement with the State of North Dakota; the motion carried. The commission reported total county expenditures from June 23, 2021, through July 8, 2021, of $1,357,795.93 and stated a detailed list of checks is available for public inspection during regular business hours at the Morton County Auditor’s Office.
The meeting was adjourned at 8:12 p.m. after a motion by Commissioner Boehm and a second from Commissioner Morrell.
