Polk County approves PFC board appointment; ICE/MTC contract delays keep revenue timing uncertain

Polk County Commissioners on March 24 approved appointing Terry Williams to fill a vacancy on the IAH Public Facility Corporation (PFC) board as the PFC moves from bondholder-focused operations toward protecting county assets and funding facilities.
County staff said the bonds that once required trustee oversight have been retired, shifting the PFC’s principal obligation to Polk County facility preservation and to capturing administrative fees and other revenues previously distributed to bondholders. Staff described a multi-step transition: terminate prior trustee arrangements with the bank, open local accounts under county oversight, and ensure legal and contractual alignment among the PFC, MTC (the management contractor), ICE (the contracting federal agency), and the IRS.
Officials explained that ICE has repeatedly requested short extensions of its contract renewal with MTC; those rolling six-month extensions mean further delays in the county’s ability to transition and fully access PFC-related funds. County representatives said prior negotiations had stabilized the facility by securing a minimum-payment mechanism from ICE that helped stabilize jobs and revenues; however, until ICE and MTC finalize a renewed agreement the county cannot complete bank transitions or realize the full administrative revenues that support facility maintenance and county services.
The court approved the recommended appointment to the PFC and directed staff to continue negotiations and to keep the court informed as ICE and MTC resolve the contract status. No immediate change to county operations was enacted; staff characterized the next steps as administrative (bank account changes, finalizing agreements) pending federal contract actions.
