APC approves three-lot minor subdivision after surveyor told to resolve floodplain mapping

The Boone County Area Plan Commission voted July 1 to approve petition 26MA-7M-075, a minor residential subdivision in Marion Township that divides a 7.14-acre parcel into three lots, contingent on the surveyor providing updated floodplain information and staff approval of that data.
Nicole, planning staff, summarized TAC comments and said the APC had received soil-boring reports and that drainage permits and driveway permits will be required for any built lots. Staff also noted that the plat must show the best-available floodplain and floodway data from the Department of Natural Resources (DNR) and that, as of the meeting, the surveyor had not supplied the most recent DNR layer.
Mitchell Smith, speaking for property owner Brian Concincaid, said he intends to build on lot three and that the surveyor is working to update the plat’s floodplain layer (the application currently contained older FEMA data). "Our layer is from 2015 FEMA instead of 2018 DNR," Smith said, and he expected the surveyor to provide the correct data.
Board members stressed the importance of resolving whether portions of any proposed lot fall within flood fringe or floodway, noting that buildings are not allowed in floodway and that a future mortgage company could require flood insurance if FEMA maps are updated. Staff said the executive director will approve the corrected floodplain information prior to plat signatures to avoid future complications.
A motion to approve 26MA-7M-075 with the condition that floodplain data be updated and approved by staff, and that any necessary access easement language be added to the plat, was made and seconded; the APC voted in favor with no recorded opposition.
The approval is conditioned on the surveyor providing up-to-date floodplain/floodway mapping and on the recording of required permits and easements; the APC directed staff to work with the surveyor to resolve the mapping discrepancy before final plat signatures.
