Wilbur Planning Commission approves findings for petition 26 0 1 after correcting code reference

The Wilbur Planning Commission approved findings of fact for petition 26 0 1 at a special meeting, amending the language to correct a municipal-code citation before voting to send the record to the Board of Works for pending appeals.

Heather, a staff member, told the commission these proposed findings would normally be presented at the commission’s next regular meeting but that providing them now would give the Board of Works the written record it needs to consider appeals in a timely way. "These are the findings if you wanna add, delete, any corrections, can expedite moving this forward," she said.

Kevin, the clerk, stressed the Board of Works also needs the commission’s February minutes and the written findings as part of a complete record. "In order to proceed in order for the Board of Works to render an opinion on any of the appeals, it needs your minutes from be from February and it also needs the written findings," he said.

A committee member moved to approve the findings of fact for "petition 26 0 1" and the motion was seconded. During discussion, Kevin pointed out a Scrivener's error in the draft findings: paragraph 3 referenced "section 150.14," but the correct citation should read "section 150.104." The mover amended the motion to incorporate that correction and the amendment was seconded.

The commission then voted on the amended motion. Several members were recorded as voting "aye" during the roll-call-style confirmation — including Schultz, Perry, Gallagher, Hanna and Metz — and the meeting record notes there was "only one no." The transcript does not unambiguously record every member's individual vote; the commission forwarded the approved findings to the Board of Works for its consideration of the appeals.

After the vote the commission moved to adjourn and closed the special meeting.
