Osceola council adopts six ordinance changes, schedules hearing on Alliant Energy easement

The Osceola City Council adopted a package of ordinance changes and set a future public hearing during its Sept. 16, 2025 regular meeting.
Council Member George Fotiadis moved and Council Member Thomas Bahls seconded passage of a resolution setting a public hearing for Oct. 7, 2025 at 7:00 p.m. on the proposed conveyance of a perpetual easement to Alliant Energy; the motion carried on a unanimous roll call vote (Fotiadis, Sullivan, Bahls, Hicks — aye). The City Clerk was directed to publish notice as required by law.
The council then considered multiple ordinance changes. After brief public hearings with no members of the public commenting, the council approved the first readings and in each case voted to waive second and third readings, enacting the following ordinances by unanimous vote:
- Ordinance 685, amending provisions related to liquor licenses and wine and beer permits, including rules about on-premises storage and references to Code of Iowa Sec. 123.49(2)(d)(2)-(4).
- Ordinance 686, revising Chapter 121 (Cigarette and Tobacco Permits) to define terms (including alternative nicotine products and vapor products), set permit requirements and fees, and prescribe civil penalties and permit-suspension/revocation processes aligned with cited Code of Iowa sections.
- Ordinance 687, amending conflict-of-interest provisions regarding compensation and holding multiple city offices where not prohibited by law.
- Ordinance 688, updating public hearing notice and budget-hearing publication language to align with Code of Iowa timelines.
- Ordinance 689, modifying public-notice requirements for Planning and Zoning Commission and Council hearings, including notice to abutting or opposite property owners listed by developers.
- Ordinance 690, adding Section 55.24 to prohibit intentional misrepresentation of an animal as a service animal or service-animal-in-training for the purpose of obtaining rights under state or federal law.
Council members who made or seconded motions included Council Member George Fotiadis, Council Member Luci Sullivan and Council Member Thomas Bahls; votes were recorded on roll call as Fotiadis, Sullivan, Bahls and Hicks (aye) for the items noted above. No public commenters spoke during the hearings on these ordinances.
Why it matters: The package makes several regulatory and procedural changes that affect local businesses (liquor and tobacco retailers), notice procedures for land-use and budget matters, ethics rules for municipal officers and volunteers, and local enforcement around fraudulent representation of service animals. The Alliant Energy easement hearing scheduled for Oct. 7 is a forthcoming public decision point where residents can comment.
What’s next: The Alliant Energy easement will be the subject of a public hearing at the Oct. 7 council meeting. The recently enacted ordinances take effect after final passage, approval and publication as provided by law.
