Committee begins review of subdivision public-use dedication language in §1246.8

Law Director Tom Kelly briefed the Building & Building Codes Committee on May 20 about planned revisions to Codified Ordinances Section 1246.8, which governs dedication of land or in-lieu payments for public-use areas in subdivisions. Kelly said the ordinance currently gives Planning Commission discretion to require dedication or an in-lieu payment—historically calculated as about 8% of undeveloped land value—but that a recent Ohio Supreme Court decision has prompted staff to re-examine the city’s approach.
Kelly said Planner Russell and Assistant Law Director Schrader are drafting amendments to bring the code into line with both the court’s guidance and the city’s enforcement experience. Chair John Nickell questioned whether the current minor-subdivision exemption (five lots or fewer) and the percentage approach remain appropriate. Kelly clarified that minor subdivisions of five lots or fewer are currently excepted and said the staff work will consider suitable thresholds and remedies to ensure approved plans are actually carried out.
The committee did not adopt revisions at the May 20 meeting; staff will return with proposed code language for further review and possible action.
