West Whiteland board adopts Verizon cable franchise, approves settlement and wastewater agreement; tables zoning amendment

At its Feb. 25 meeting the Board adopted an updated cable franchise with Verizon, approved a settlement to end litigation with Boot Senior Property, and consented to a DARA capacity transfer amendment; the board also agreed to apply for a DVRPC streetscape grant and upgraded police records software.
The West Whiteland Township Board of Supervisors on Feb. 25 moved through a package of administrative and contractual items, adopting a cable franchise renewal with Verizon and approving several intermunicipal and litigation-related agreements.
The Board adopted Ordinance No. 487 (cross-referenced as Resolution No. 2026-12) authorizing renewal of the cable franchise agreement between West Whiteland Township and Verizon Pennsylvania LLC and authorized execution of the agreement. The motion was made by Vice Chair Rajesh Kumbhardare, seconded by Supervisor Libby Madarasz, and passed unanimously.
Solicitor Alex Baumler summarized a negotiated Settlement and Claim Offset Agreement with Boot Senior Property, LLC that will terminate pending litigation over a previously denied land development plan; the Board approved the settlement on a unanimous vote.
The Board also approved the Seventh Amendment to the 1985 Downingtown Area Regional Authority (DARA) Intermunicipal Agreement to allow East Caln to transfer 50,000 gallons per day of sanitary capacity to Uwchlan Township and the Uwchlan Township Municipal Authority. The amendment requires consenting parties to waive certain rights to purchase that allocation; the Township Manager was authorized to execute the amendment if no material revisions are made.
Separately, the Board tabled a proposed zoning-ordinance amendment to regulate data centers on a motion by Kumbhardare, seconded by Madarasz.
On financial matters, the Board approved the Township Payment Report for Feb. 25, 2026, after staff answered member questions. The Board acknowledged receipt of the 2025 Annual Report for the Planning & Zoning Department as required by the Municipal Planning Code.
In staff updates, Capital & Special Projects Manager Justin Smiley said Staff will apply for a Delaware Valley Regional Planning Commission (DVRPC) transportation and community development initiative grant focusing on Exton Crossroads streetscape and multimodal gateways; Smiley said the grant application is due March 13, 2026 and that the award does not require a local match. Police Chief Lee Benson reported the department upgraded its records system from CODY to PATHFINDER and recognized staff who led the transition.
