County counsel and staff reviewed the draft contract and discussed standard protections — a performance/payment bond, liquidated damages, and contingency budget lines — and detailed an estimated base cost of about $473,787 with additional contingency. Staff explained the county’s ability to place a multi-year project in fund accounting and carry funds forward to pay across fiscal years.
Commissioners voiced concern that the contractor had not finished prior work (notably an elevator project) and wanted assurances that the roof project would not begin before the prior project was complete. One commissioner said liquidated damages would be available if the contractor missed deadlines, but others asked for clearer budget numbers before proceeding.
The board voted to table the contract for one week so staff could confirm how much funding is available in the current year and to invite TCS Northwest to attend and answer questions. “If they’re behind, we’ll start hitting them with liquidated damages,” a commissioner said, underscoring enforcement options, while another urged caution because delayed action could push the work out of this building season.
Staff flagged that the county can budget a two-year project in fund accounting and carry revenue forward, but late-year timing likely pushes most payments into the next fiscal year.
The contract remains under consideration; the board requested a financial update at the next meeting and a chance to have TCS address completion schedules and bonding.
