The Charlemont Planning Board reviewed prior counsel advice and decided to send a compliance letter to Topstitch Upholstery at 2069 Mohawk Trail asking the business to operate under the conditions of its existing Special Permit or to apply for a new permit that fits its current operations.
Board members read an email from Carlene that recommended requesting compliance or requiring a new Special Permit, which could involve the Zoning Enforcement officer if not addressed. Bob Nelson read a draft letter at the meeting and said he would edit it to incorporate a 2021 letter from Bill and the original 1989 Special Permit documents before sending it to the property owner and the business.
The board did not vote to initiate enforcement at the Oct. 16 meeting; members favored a formal written request for compliance as the next step. If Topstitch fails to respond or comply, the board noted the matter could be referred to the Zoning Enforcement officer per standard procedures.
