Planning board flags deviation from approved Hinata plan after site visit, will request clarification

The Charlemont Planning Board said it will contact the consultant who emailed them after a site visit reported that the Hinata development’s cabins differ from the approved plan by two units.
Members read the email from Jeff Lacy and noted a discrepancy between the built layout and the plan presented to the board. The board recalled the Special Permit authorized limited flexibility for size and placement if blasting or wetlands prevented building exactly as drawn.
Board members discussed unit-sizing specifications: the permit calls for 504 square feet per unit ±10 percent, with decks treated separately at 120 square feet ±20 percent. Members said Jeff Nielsen had chosen smaller unit sizes and that, while some deviation may be allowable, they expect consistency with the Special Permit overall.
The board agreed to email Jeff Lacy to thank him for the notice and to ask whether the remainder of the project will follow the approved plan; they also agreed to continue site visits and to require that any necessary plan amendments be filed when Jeff Nielsen applies for additional permits.
No enforcement action was taken at the meeting; the board will decide next steps after receiving Lacy’s response.
