The decision followed review of an email from Jeff Lacy noting that the on-the-ground layout differed from drawings presented during the special-permit hearings. Board members discussed whether the changes met the special-permit standard for a “substantial” modification and agreed they did not. Board member Bob Nelson made the motion; Lori Shulda-Merrigan seconded it, and the motion passed unanimously.
The finding does not preclude future review. The board said it will raise the issue with Nielsen at a site visit or other opportunity and plans additional inspections, including a winter drive-by, to monitor the installation. The board emphasized that future revisions should be brought to the Planning Board in advance so the board can decide whether any change is substantial enough to require a permit amendment.
The board’s action resolves the immediate question about the two relocated cabins but preserves the board’s ability to revisit the permit if additional or different changes are made.
