Trustees declare two properties nuisances as inspections and hearings continue

The Board of Trustees repeatedly addressed two problem properties in 2008, using inspection reports, sworn affidavit evidence and public hearings to direct remediation or to authorize removal and cost recovery under Ohio law.
3588 Cemetery Road: Following a site inspection, Captain Eric Manske of the Fire Prevention Bureau filed an affidavit describing the former residence as unsafe and structurally defective following burn training and later neglect. Photographs submitted with Manske’s affidavit showed missing roof sections, missing doors and windows, and debris scattered across the lot. At the March 17 meeting trustees adopted a resolution declaring the property a nuisance and set an April 7 hearing to allow recorded owners and lienholders to be heard. Owner Daniel Auld requested an extension in April and proposed rebuilding plans; trustees signaled they would consider a sixty-day timeline and required a formal demolition contract if work was to proceed. On June 2 trustees acknowledged the owner had remediated the property to their satisfaction at that time, but recorded the requirement that grass and yard maintenance meet Franklin County Board of Health standards. A hearing record and the Board’s resolution reference Ohio Revised Code Sections 505.86 and 505.87 as the legal authority for removal and cost recovery.
3226 Thoburn Road: At the April 21 meeting the Board adopted a separate nuisance resolution under §505.87 of the Ohio Revised Code for the property at 3226 Thoburn Road, identifying uncontrolled vegetation, wood piles, a junk vehicle/camper and debris. The resolution ordered removal or arrangements for removal within seven days and authorized the township to contract for removal if the owner failed to comply, with costs to be recovered via the tax duplicate.
Trustees used standard procedural steps—site inspections with the Franklin County Board of Health, sworn testimony, and formal Board resolutions—to establish legal notice, set hearing dates and allow for administrative enforcement. Multiple minutes record that when owners comply the Board will acknowledge remediation; when they do not, the Board authorizes removal and cost certification to the county auditor for collection.
