County staff reviewed a draft response to the City of Stateline’s request for reconsideration after the board previously denied the city’s proposed area of impact. Legal counsel and commissioners discussed the letter and the next steps during the board’s June 30 status meeting.
Pat, who spoke at the meeting in response to questions about court risk, said the draft letter explains the county’s rationale but stressed the decision is not final until a public hearing. "First of all, this is merely [a] discussion item. It's not an action," Pat said, adding that a final decision will be made after evidence is heard. Staff confirmed a public hearing on reconsideration is scheduled for Aug. 27 at 10:00 a.m.
Several commissioners and staff noted the substance of the county’s planned response: Stateline does not appear to have applicable plans or a comprehensive plan that would qualify as an "applicable plan" under the statute, which county officials said they will include in their rationale. One commissioner said, "Stateline does not appear to have any plans whatsoever," arguing that absence of plans supports the county’s prior denial.
Commissioners asked that the draft letter be amended to make clear it does not represent final agency action and that a public hearing will be held on Aug. 27 at 10:00 a.m. Staff said they would add that language, circulate the amended letter to the board for signature, and return to the record; a second was offered when the chair requested it, and staff indicated they would send the letter once signed.
The discussion was procedural and preparatory for the scheduled hearing; commissioners did not make a final decision on the area‑of‑impact at the meeting.
