Authority approves findings for Petition 2601 after correcting municipal-code citation

The Hobart City Redevelopment Authority met in a special session to approve findings of fact for Petition 2601 (Philponen) and to correct a clerical municipal-code citation before related appeals go to the Board of Works.

Heather, a city staff member, told commissioners that multiple appeals of the permit have been filed and that, under the municipal code, appeals proceed to the Board of Works, which must respond in writing. "These would have been presented to you at your next meeting, your next plan commission meeting," Heather said, urging the commission to finalize its findings so the Board of Works has a complete record.

The issue mattered for the record: a staff member noted the Board of Works needs the commission's February minutes and the written findings to fully consider the appeals. "It needs your minutes from be from February and it also needs the written findings," the staff member said.

Committee member moved to approve the findings of fact for Petition 2601 (Philponen). During discussion, staff identified a Scrivener's error in paragraph 3: the municipal-code section referenced as "150.14" should read "150.104." "It should read section 150.104 and not 140," the staff member said. The mover amended the motion to include the correction.

The commission took a roll-call vote on the amended motion. Several commissioners responded "aye" and at least one commissioner registered a "no"; the chair announced the business concluded after the roll call and the motion was carried. The commission did not specify additional conditions in the meeting record; the corrected findings and the February minutes will be forwarded for the Board of Works' consideration.

The special meeting closed after the vote and an adjournment motion.
