Police Jury introduces ordinance to sell multiple adjudicated parcels, reserves mineral rights

The Ouachita Parish Police Jury introduced Ordinance No. 9504 at its Nov. 18 meeting to authorize Acts of Sale for seven adjudicated parcels and to set conditions for those sales. The parcels are described by parcel numbers and municipal addresses in the ordinance; purchasers and bid amounts at the referenced auctions are recorded in the minutes for each parcel.

Key conditions in the ordinance include: sales to be made without warranty and by certified funds, reservation of all mineral rights to the Parish while conveying surface rights, and use of a parish-attorney-approved sales form. The ordinance requires E&P Consulting, LLC to certify in writing that mortgage, conveyance, probate and civil-suit records have been examined and to provide a written list of owners, mortgagees and others who may have an interest. E&P Consulting must also provide proof of notice and certify that the statutory period for redemption has elapsed prior to closing.

The ordinance authorizes the Police Jury President to execute Cash Sales to the highest acceptable bidders and to include the conditions set forth in the ordinance. The ordinance text and parcel list are recorded in the minutes, including purchaser names and bid amounts for the auctions noted on the agenda.

The Jury will proceed with standard sale and closing procedures required by La. R.S. 47:2201 et seq. and related parish ordinances.
