The Orderville Planning and Zoning Commission voted July 30 to approve a simple-lot subdivision request from the Kane County School District to adjust legal descriptions on a 40-acre property.
Chair of the Orderville Planning and Zoning Commission said the commission reviewed maps and found the applicant’s proposal met the town’s requirements. Chris Eaton, representing Iron Rock for the district, said the district purchased the full 40 acres and is carving off a 9.67-acre parcel while retaining a 1.09-acre parcel separated by Cottonwood Lane. "They're gonna retain that, but we're showing it as separated because it's separated by the road there," Eaton said.
Commissioners clarified that the small parcel will remain under the same tax identification number despite having a separate legal description, and discussed whether the parcel could be sold off in the future. Eaton told the commission the district will retain the parcel for now and that the change is a housekeeping action to produce more precise legal descriptions.
The commission also addressed access and zoning questions. Members noted the parcel has access from Cottonwood Lane and observed that, depending on future use, conditional-use reviews would still apply under either AG or RRC zoning. The commission emphasized that any future development would require the town’s site-plan and parking reviews.
A commissioner moved to approve the subdivision application; the motion was seconded and carried. Chair noted one abstention (Leticia), and the commission instructed staff to draft an approval letter reflecting the decision and the updated signature block requirements under recent state law.
The commission’s action is a recommendation to file the signed approval; the town will process the necessary documents and update the legal descriptions.
