Deephaven considers tighter limits on commercial uses, including ban on auto repair in downtown zone

The Deephaven City Council on July 7 reviewed proposed amendments to permitted uses in the city's commercial zoning districts that would narrow allowable businesses in downtown and other commercial areas.
Planning Director Pat Smith told the council the Planning Commission recommended prohibiting automobile repair in the C-1 (Downtown Commercial) district and removing the prior 'prohibited use' section in favor of a rule that any use not expressly listed in the permitted-use chart would be prohibited. Councilmember Tony Jewett asked specifically about fast-food restaurants; Smith said the Planning Commission was "concerned that the amount of traffic that a fast food restaurant generates would not be appropriate for any of the three commercial districts."
The change is designed to give the city clearer authority to deny uses that would generate traffic or other impacts not suitable for the districts. Staff and the commission noted that a use not on the permitted list could still request a zoning amendment from the council. A second reading on the proposed ordinance is scheduled for Aug. 4, 2025.
