Code enforcement officer Drew Wilson told the commission the town’s unsafe-building action began March 3, 2025, after a routine inspection found the front door “busted” and unsecured. Wilson said subsequent inspections documented the door and lock being destroyed, interior fixtures and copper wiring removed, and broken glass that posed a hazard. The town purchased materials and boarded the door and windows to prevent entry and posted an unsafe-building notice.
Wilson said the town sent certified notices to the property owner and to the registered agent; the notices were signed by the agent and the petitioner’s attorney but the property owner, identified in the hearing as Three Brothers LLC, did not respond. Staff told the commission they would attempt to recover the $29,546 in emergency-material and notice costs and also pursue other administrative expenses and contractor costs under the town’s unsafe-building process; those additional costs were described separately and are subject to other administrative actions.
Commissioners asked whether the town intended to pursue eminent-domain or demolition; staff said tonight’s item was limited to affirming emergency actions and the associated cost. Staff also noted that continued nonresponse could lead to further steps, including potential abandonment proceedings for the property, which would be a separate determination by the town council.
After questions, the commission moved to affirm the necessity of the emergency action and the $29,546 cost as reasonable and recoverable; the motion passed unanimously among members present. Planning staff said the town will place a lien on the property for amounts not paid and will continue to pursue additional contractor and administrative costs under separate processes.
