The Athens‑Clarke County Planning Commission on July 2 recommended approval of a future land‑use map change and a rezoning of 1490 Whit Davis Road from RS25 to AR, with conditions aimed at preserving neighborhood character and limiting future commercial uses.
Staff had recommended denial, saying the proposed AR district would create an isolated zone and did not meet the county’s housing goals. County planning staff noted the property is a 9.4‑acre historic homestead adjacent to Whit Davis Elementary School and that the request would change the future land‑use designation from single‑family residential to rural.
The applicant, represented by planner Kayn KD and consultant Ed Lane, said the owners Mark and Mindy Ballal intend to restore and preserve the house and outbuildings and to keep the property as their primary residence. They said AR zoning would allow preservation without piecemeal subdivision and would permit limited accessory structures and occasional small community activities using temporary permits. Owner Mindy Ballal said the family’s goal is “to protect this homestead and preserve its remaining acreage.”
Neighbors opposed the rezoning, citing the potential for spot‑zoning and future change of use. Cass Hall, speaking for multiple neighbors, referred to a petition of community opposition and urged the commission to follow staff’s recommendation to deny. Opponents pressed for alternatives such as conservation easements or variance requests and questioned the lack of binding limitations on events and commercial activity in perpetuity.
Commissioners voted first to recommend the future land‑use map change and then to recommend rezoning to AR with three conditions: the property must meet RS25 canopy requirements, must be subject to RS25 livestock limitations, and must not include commercial uses such as feed lots, slaughterhouses or kennels. The motion passed 5–2. Commissioners said the conditions were intended to address chief neighborhood concerns while allowing the owners to pursue preservation goals.
The commission’s action is a recommendation to the mayor and commission; any final zoning ordinance and related enforcement measures will be decided in subsequent steps.
