He said the court had previously ordered a special election between Josephine Isom and John David, but "this decision was affirmed by Judge Seale on November 13" and, he added, Ms. Isom has since filed an appeal through her attorney, "so, that makes that decision moot." Mr. Montgomery said the council was preparing to set a date but must wait for the appeal.
Council members said they will await action by the higher court before scheduling an election and expressed hope the court will address the matter promptly. No new dates were set at the meeting, and the council did not take any formal action on the election schedule.
