Mulga council sets public hearing to consider creating building department and adopting technical codes

At its Aug. 20 meeting the Mulga council voted to set a public hearing for the second council meeting in September to consider Ordinance No. 2024-04, which, if adopted, would create a municipal building department, designate a building official and adopt technical building and safety codes by reference.
Ben Goldman explained why the council must hold a public hearing when adopting technical codes by reference. "The statutes say that you can adopt them by reference instead of having to actually have that in your ordinance... The impact of that is that we have to go through this extra step of setting a public hearing when we adopt a technical code by reference," he said.
The proposed ordinance would adopt the 2021 editions of several International Code Council codes — including the International Building Code, International Existing Building Code, International Residential Code, and related mechanical, plumbing and fuel gas codes — and the 2020 National Electrical Code. The council did not adopt the ordinance at the Aug. 20 meeting; the public hearing is scheduled so the council can receive public comment prior to any final vote.
Lisa Armstrong moved to adopt Resolution No. 2024-09 to set the hearing; the motion passed by roll call with all members voting yes. The council will consider the ordinance following that hearing.
