Office counsel presented the proposed orders. The Commission approved the payments and conditions in a single motion that passed unanimously. The penalties presented and approved were: Charter Senior Living at Hermitage — $4,500; Legacy Village of Hendersonville — $2,500; Life Care Center of Elizabethton — $1,500; Royal Retreat — $6,000; Spring City Care and Rehabilitation Center — $2,000 (plus a Type C pending CMP should the same violations recur within 12 months); Kempton of Hermitage — $3,000; and Somerby of Franklin — $4,500 with the facility license placed on probation for a period not to exceed six months and required appearances at regularly scheduled Commission meetings.
Ms. Sweitzer moved to approve all orders as presented and Mr. Evans seconded. The motion carried unanimously. The Commission’s action requires the assessed penalties to be paid within 30 calendar days of the orders’ effective dates; the transcript notes the possibility of additional penalties (Type C) for repeat violations in at least one case (Spring City).
