Health Facilities Commission approves four Certificate of Need applications, notes recusals

The Tennessee Health Facilities Commission approved four Certificate of Need (CON) applications at its Dec. 11, 2024, meeting in Nashville, expanding home infusion services across large multi-county areas and approving a new 40-bed rehabilitation facility.
The commission, chaired for the meeting by Vice-Chairman Melanie Keller, voted to approve two applications from KabaFusion TN, LLC that would, together, extend home infusion and injection services to 93 Tennessee counties (CN2405-012 and CN2408-021). The first application (CN2405-012) was limited to providing infusion and injection products to pharmacy patients of KabaFusion subsidiaries and covers a 67-county service area; the second (CN2408-021) covers a separate 28-county area. Barbara Brennan moved to approve CN2405-012, with Johnny Lai seconding; five members voted yes (Lai, Brennan, Denney, Evans, Biggs); James Wright and Melanie Keller were recorded as recused. For CN2408-021, Lai moved and Tim Evans seconded; five members voted yes (Lai, Denney, Evans, Brennan, Biggs); Wright and Keller were recorded as recused.
TriState Infusion, LLC (CN2409-024) received approval to add 37 counties to its existing Middle/West Tennessee service area; the license will remain limited to infusion therapy nursing. The staff-recorded motion to approve (moved by Barbara Brennan, seconded by Tim Evans) passed 6-0-0 with Vice-Chairman Keller recorded as recused. Staff noted the estimated project cost at $52,200.
CSH/LO Behavioral Health and Rehabilitation Tennessee, LLC (CN2409-027) was approved to establish a 40-bed rehabilitation facility in Ooltewah serving seven Tennessee counties and four adjacent Georgia counties. Nicole Sweitzer moved to approve with Jeremy Biggs seconding; the motion carried 6-0-0. The estimated project cost was recorded as $79,986,079; Tim Evans was recorded as recused on this item.
Motions and vote results were recorded in the meeting minutes for each item (for example, staff noted "The motion CARRIED [5-0-0]" or "[6-0-0]" as appropriate). Staff also reminded the commission that, under Public Chapter 557 and TCA § 68-11-1616, written findings are required only for denials of CON applications filed on or after Oct. 1, 2021; approvals may be recorded by simple motion.
The commission adjourned after taking the approvals and recording recusals and votes. Several other CON applications on the agenda were deferred for consideration at future meetings.
