Commission hears DOS referral on seawall and picks interim chair for next meeting

The Harbor and Coastal Zone Management Commission briefly handled administrative items after the 308 Melbourne Avenue discussion, including a referral from the Department of State concerning proposed seawall reconstruction at 1067 Oaks Lane.
Planner Dan said the state issued a DEC permit but the project still requires local LWRP consistency review and must submit local materials for the village’s review. ‘‘The state actually issued their DEC permit already,’’ Dan said, adding that the state referral does not relieve the homeowners of local consistency obligations and that staff will request appropriate submissions.
Dan offered to circulate a short slide deck summarizing Local Waterfront Revitalization Program (LWRP) basics — what actions are subject to consistency, exempt actions, and the relevant local policies — for new commissioners. Counsel clarified that local consistency advice is generally provided when it would materially change the State’s view or identify local conditions the state may not have considered.
Commissioners also addressed internal governance after the outgoing chair said he was stepping down; the current chair offered to serve as the designated chair for the January meeting, the commission seconded the nomination and approved a one‑meeting designation. Staff will continue discussions about a permanent chair appointment.
