Council approves road-opening permit with restoration conditions for Pendrella Properties

South Plainfield Mayor and Council on Monday approved Resolution 25-362A to permit a road opening for a development project, after a representative for the developer asked the council to waive a provision that had blocked utility permits.

P.J. Panella, representing Pendrella Properties, told the council the project is bonded and that sewer connections and some road work were already completed. He said a subsequent ordinance and utility-company bonding procedures had prevented issuance of the gas and water permits and asked the council to allow the road opening so work could continue. Panella told the council he was prepared to pay to restore the street “from property line to property line” and to pay for milling so the road would be rebuilt after utility work.

Mr. Rizzo, presenting the resolution, said the permit would be granted under the borough’s road-opening code with conditions requiring the applicant to perform all restoration work in accordance with the borough engineer’s directions. The council then moved, seconded and recorded affirmative roll-call votes to adopt Resolution 25-362A.

Council President White noted the request would be included in that night’s consent vote and the council recorded votes in favor from the members present. The resolution specifies the applicant must complete restoration work to the engineer’s standards; the council recorded the vote and the permit passed as presented.

The decision clears the way for the developer to seek utility permits and continue construction, subject to the restoration and bonding obligations laid out in the resolution. No additional public comment on the item was recorded.
