The Big Horn County Commission voted July 15 to approve a Planning & Zoning Commission recommendation to exempt certain "simple subdivisions" from some fencing, homeowners' association and other rules aimed at major subdivisions.
May, a county engineering/road-and-bridge presenter, outlined the October 2023 recommendation and said the goal is to reduce burdens that are disproportionate for small, simple splits of property. Deputy County Attorney Jennifer Kirk urged that the regulations include explanatory notes so that restrictions and responsibilities follow appropriately when property ownership changes.
Commissioner Bruce Jolley moved to approve the Planning & Zoning recommendations as presented; the motion was seconded and carried. The action does not specify new substantive standards in the meeting record; staff were directed to update the subdivision regulations and accompanying notes per the discussion.
The change is intended to ease administrative and development burdens for small-scale land divisions while preserving regulatory clarity, Kirk said; the record does not show the final text of the amended regulation nor an effective date. Planning and Zoning materials referenced in the meeting were from October 2023; commissioners did not provide a timeline for publishing the revised regulations.
