Commission backs rezoning and approves Wright’s Gymnastics plan after waiver for driveway alignment

The Avon Advisory Plan Commission unanimously recommended approval of ZA 2601, a zoning map amendment to rezone 2.27 acres (Lot 13, 8170 Kingston Street) from a split I2/C2 designation to exclusively C2, and then approved DPR 26-04 (Wright’s Gymnastics) and a related waiver for driveway spacing.
Staff explained the rezoning corrects a split zoning situation and is consistent with the comprehensive plan’s recommendation for commercial office uses; staff also described that a recent Board of Zoning Appeals variance to locate a trash enclosure in the front yard was denied and the petitioner revised the DPR to relocate the trash enclosure behind the front building line. Staff advised that Department of Public Works prefers a recorded pedestrian easement in place of dedicated right-of-way to accommodate sidewalk and parkway trees, and recommended a favorable recommendation to Town Council on the rezoning.
Dylan Reynolds (Space Co), civil engineer for the owner, said the revised DPR reduces the building footprint slightly to accommodate the relocated dumpster and added sidewalk/landscape adjustments. Petitioner representatives noted the trash enclosure is sized for two 8‑yard dumpsters and that Wright’s Gymnastics will occupy roughly half the building and be a part owner of the facility, which petitioner said provides an incentive to maintain the enclosure.
Staff asked the commission to consider Waiver A to permit a full-access driveway on Kingston Street approximately 80 feet from the Kingston–Dover intersection (short of the ordinance’s required separation) so the driveway would align with an existing access point to the south. Staff and Public Works said alignment consolidates points of conflict and improves safety compared with offset driveways; the commission found the four waiver findings were met and approved the waiver.
After motions and seconds, the commission voted unanimously to forward a favorable recommendation for ZA 2601 to Town Council, to approve Waiver A for the driveway alignment, and to approve DPR 26-04 subject to revised staff conditions. Commissioners urged the petitioner to consider shared access with the neighbor to the west in the future and noted fire-department entrance expectations.
The approvals allow the petitioner to move forward with recording required easements and subsequent permitting; staff included conditions that the pedestrian easement must be recorded and that the zoning amendment be approved by Town Council prior to issuance of a building permit.
