Norwell adopts ADU changes and multiple zoning edits; two major zoning proposals fail 2/3 counted votes

Voters at Norwell’s Annual Town Meeting on May 4 took action on a package of zoning and land-use articles, approving several amendments while rejecting two proposals that required a 2/3 supermajority.
The Planning Board’s Article 34 — a comprehensive set of changes to the town’s Accessory Dwelling Unit (ADU) rules — passed by unanimous voice vote. The adopted provisions create a category of "Protected" ADUs allowed as-of-right on single-family lots, limit ADU size to no more than half the gross floor area of the principal dwelling or 900 square feet (whichever is smaller), require Title V/Board of Health documentation for sewage disposal, mandate at least one on-lot dedicated parking space (with an exemption for lots within 0.5 miles of a transit station), and prohibit short-term rentals for ADUs via a recorded restrictive covenant enforceable by the town.
The meeting also approved Article 29 updating zoning definitions (terms such as Ridge Height, Grade Plane, Story and Permitted Projections) and Article 32 updating sign regulations for Business Districts A, B and C.
Two substantial proposals requiring a two-thirds majority failed when voters demanded counted standing card votes. Article 30 (amendments to intensity-of-use regulations, including lot-area exclusions related to stormwater management and altered height/ridge-height measures) was initially declared passed by voice but was challenged; the standing counted tally was YES 56 / NO 53 (73 votes were required for a two-thirds majority), so the Article failed. Article 33 (extensive new and revised rules for shared and common driveways including technical construction standards, easements, homeowners’ association maintenance obligations, and Planning Board special-permit rules for longer common driveways) likewise failed after a challenge; the standing counted tally was YES 58 / NO 43 (68 needed to meet two-thirds), so the Article did not pass.
Other zoning changes succeeded: Article 31 revised uses in Business District C and passed; Article 32 updated signage rules across business districts and passed by voice vote.
Next steps: Zoning changes that passed will be incorporated into the Norwell Zoning Bylaw by the Town Clerk; failed articles may be revised and refiled at a future Town Meeting.
