Athens staff outline draft rules for battery energy storage systems in Industrial zones

City Planner Ronda Cockerham presented draft language Feb. 18 to add “Battery Energy Storage Systems” (BESS) to Chapter 22, Article IV, Section 2232(O) and Appendix A (A‑3) and to permit BESS in Industrial zoning districts only through a Specific Use Permit.
Cockerham said the proposal mirrors many of the controls discussed for data centers: prohibited locations would include residential and mixed‑use districts, floodplains and wetlands, and any area that cannot meet buffer/separation standards. The draft would require setbacks, screening and sound mitigation, NFPA‑required safety signage, a complete inventory of installed equipment, proof of general liability insurance, and detailed SUP application materials and certifications.
Staff also proposed decommissioning plans supported by financial security (bonds) and an environmental monitoring program. The presentation included a zoning map showing potentially affected parcels and highlighted the Industrial districts as the intended location for the use.
Commissioner Jim Kerlin disclosed that his employer had prior involvement with battery energy storage systems; the disclosure was recorded on the public record. No formal actions or votes were taken during the work session. The session closed at 6:10 p.m. and staff will return with draft ordinance language for additional review.
