East Windsor — Board members discussed the process to fill two upcoming Board of Education vacancies and the implications of a legal opinion on party eligibility.
The legal opinion circulated to the board explained that when an incumbent changes party affiliation while in office, there is a three‑month window in which they remain counted under the party they ran under, after which they are considered part of the new party. Board members said that interpretation means the two open seats cannot be filled by Democrats and instead must be filled by candidates who are Republican, unaffiliated, or from another non‑Democratic party. The town attorney’s election‑law opinion was the basis for that clarification.
Board members also reviewed and approved (for distribution) an updated flyer announcing the vacancies, with an application deadline of Jan. 15. Jess reported three completed applications have been received and several additional inquiries were pending. Members discussed whether candidate interviews should be held in open session—so questions are public—or in executive session; there was broad support for asking questions in public and holding deliberations or final candidate discussions in executive session to protect candidate privacy.
The board asked staff to respond to applicants to confirm receipt and outline the process, and to coordinate further outreach via the town website, Facebook and selectmen meetings. The board aims to hold interviews before the February decision deadline where possible.
