Council approves Babbling Brook license to run Frear Park restaurant after Q&A on fees and capital work

The Troy City Council on April 9 approved a license agreement authorizing the mayor to contract with Babbling Brook New York Corporation to operate the Frear Park restaurant concession.
The measure drew extended questions from council members in finance committee and at the full meeting about several commercial terms that were left incomplete in the draft. Council members asked staff about a blank line in the agreement for additional license fees tied to special events and noted that the RFP referenced a possible 2% revenue-share for events. Administration staff and procurement leads told the council that the special-event fee language requires further negotiation and that staff expected to finalize that term before signing.
Council members also pressed on a five-year rent schedule in which base rent was $1,500 in 2026 and jumped to $5,500 in 2027. Council member McLaren and others asked whether revenues from the temporary tent and events would support that jump. City staff said the year-one figure mirrors the prior Park Pub arrangement and that later-year estimates were derived from market research and comparable operations; staff also said the license will require the operator to provide revenue reports so the city can monitor performance.
The council discussed capital improvements and fixtures: the operator would be able to propose capital improvements at their cost, subject to administration approval, and any installed fixtures that become part of the restaurant would remain with the facility. Members also questioned whether prevailing-wage rules or building-service clauses might apply; staff said certified payrolls are required on projects where prevailing wages apply.
Following the Q&A and an amendment process in committee, the council adopted the resolution unanimously at the council meeting.
What this means: Babbling Brook NY will operate Frear Park’s restaurant concession under a license agreement that still requires administrative finalization of certain contract terms (special-event fees, final capital-improvement language). The council recorded a unanimous vote in favor.
