Commission recommends approval of proffer amendment to reduce setbacks on Parkers Hill Drive

The Goochland County Planning Commission on Aug. 15 recommended approval of a proffer amendment that would reduce several setback and buffer requirements for a lot at 2267 Parkers Hill Drive.
Miss Parker introduced RZ-20248, an application from property owners Robert R. Harris and Karen S. McAndrew to amend proffers on a 5.973-acre lot in Algonquin Woods Subdivision. Tom Coleman, the principal planner, described the request as a revision to three lot-specific proffers from the 2005 rezoning: reducing the driveway setback from 300 to 150 feet, reducing the building setback from 350 to 100 feet, and reducing a vegetative buffer from 200 to 100 feet. Coleman said the subdivision was rezoned in 2005 with 13 proffers, ten of which remain in force and are not part of this amendment.
Applicant Rob Harris told the commission the current proffers ‘‘pin us in’’ and limit use of the parcel to roughly 1.5 acres of the six-acre lot; he said he has incurred about $9,000 in damage to personal property that he linked to access constraints. Harris called the proffers excessive and said nearby subdivisions do not have comparable restrictions.
Commissioners asked why the proffers were imposed originally; Coleman said staff could not confirm the original rationale but noted that a county ordinance amendment adopted in July now requires a 100-foot buffer where applicable. The applicants submitted amended proffer language to staff late; the commission first voted to waive the timeline to accept the late submittal and then voted to recommend approval of the amended proffers.
The motion to recommend approval passed on a 5-0 roll-call vote. Miss Parker confirmed the case will be scheduled for public hearing before the Board of Supervisors on Oct. 1, 2024 with the planning commission’s recommendation of approval.
The staff presentation noted a May community meeting with 13 attendees and mixed support for the amendment; opponents cited the original restrictions and the importance of the buffer as a habitat area, while supporters argued for property-use parity with nearby lots.
