North Royalton Council rejects conditional-use permit for proposed 120-unit assisted living facility

North Royalton City Council voted unanimously on March 3 to defeat an ordinance that would have confirmed a Planning Commission conditional-use permit for a 120-unit assisted living facility at the northeast corner of W. 130th Street and Bennett Road.
The measure, Ordinance 26-40, drew lengthy public comment from neighbors who said the proposed three-story building would be out of scale with the surrounding one- and two-story homes, reduce privacy, and increase traffic and calls for emergency services. President of Council Paul Marnecheck presided over the vote after the council moved to suspend the normal three-reading rule and vote the same night; roll call recorded no yeas and seven nays, so the ordinance failed.
Several residents presented technical and experiential objections. Architect and Spyglass Hill neighbor Eric Edwards said he prepared a site section showing the finished floor would sit about 13 feet higher than adjacent homes and that the proposed three-story massing would “completely out of character for both the existing local business district and our existing residential neighborhood.” He told council he compiled a list of existing regional facilities and said most nearby assisted-living buildings are one or two stories, with only a small number of three-story facilities adjacent to residences.
Resident and former ambulance employee James Moroney, a fire lieutenant, said local emergency responses to similar facilities have increased in recent years, citing call totals in one jurisdiction that rose from 643 in 2021 to 904 in 2025. Phil Symon cited state inspection reports for an out-of-state facility affiliated with the developer and urged caution. Several speakers raised concerns about stormwater, lighting, setbacks, property values and the appropriateness of siting a large residential healthcare building adjacent to single-family yards.
Resident Jill Moroney urged council to consider the neighborhood impact and criticized developers she said were not locally engaged, saying, “I'm not going to allow millionaire developers from Chicago to push me out of my home.” Other neighbors asked council to visit the site before taking action and to consider alternative locations closer to fire stations and town-center services.
The applicant, Vermilion Development (Vermilion Ohio Acquisitions, LLC / NR4C Ventures, Ltd.), had submitted a letter asking council to postpone a prior hearing to allow revisions and said it planned to resubmit a revised site plan to the Planning Commission; that letter is on file with the council. Council members repeatedly cited the city zoning standard that conditional uses require consideration of the effect on neighboring land and the public need for the use at that particular location.
After hearing from residents and brief council discussion, the body voted 7-0 against adopting Ordinance 26-40. The defeat means the Planning Commission approval is not confirmed by council; the developer may choose to revise plans and seek further Planning Commission and council action in the future. The meeting record shows the developer indicated plans to resubmit revised materials for a public meeting in April and to return to council with a recommended site plan contingent on Planning Commission approval.
The council handled other business during the same meeting, including adoption of a package of infrastructure and administrative ordinances.
