Hawaii County committee backs greenhouse permit exemption, raises home-repair threshold

The Hawaii County Policy Committee voted to forward Bill 2 12 to council with a favorable recommendation after briefing from the public works and building departments.

The bill would add explicit language exempting greenhouses and accessory agricultural structures up to 1,000 square feet from the county building-permit requirement and would raise the annual maintenance threshold that triggers a permit from $7,500 to $25,000. Planning staff and Public Works Director Steve Houssey told the committee the change aligns the county code with state HRS 46-88 and reflects rising material and labor costs.

Committee members asked whether exempt structures could be used as dwellings and whether wind-load or safety standards would still apply. Building division staff said accessory structures remain nonresidential and a greenhouse converted to include plumbing or electrical systems would trigger permit requirements. The planning department noted greenhouses are not taxed for property purposes under current real-property-tax guidance.

Supporters said the exemption would encourage small-scale agriculture and food resiliency, particularly in areas such as Puna that have suffered losses from lava flows. Opponents asked whether the measure should simply point to state code rather than re-stating exemptions in county code; staff said the local language clarifies allowances for properties smaller than two acres.

The committee recorded the motion to forward the bill and the motion carried with nine ayes. The item will move to the full county council for final action.
