Commission recommends vacating unimproved West Creek Drive to Common Council
Summary
The Hobart Plan Commission voted 8-0 to recommend that the Common Council vacate an 80-by-300-foot unimproved platted right of way known as West Creek Drive. Attorney Kutanovski said the road would still serve as access for the proposed lots but need not be a public dedicated street depending on INDOT and CoAction requirements.
Attorney Kutanovski, representing the petitioner, asked the commission to recommend that the Common Council vacate 80 by 300 feet of unimproved platted right of way known as West Creek Drive, west of the northwest corner of US 30 and Grand Blvd.
Kutanovski said the road would be used as access for a proposed Lot 3 and for the remainder of the Family Express parcel but argued it need not remain a public dedicated right of way depending on future INDOT or CoAction requirements. He noted the proposed street falls short by about 30 feet from the property line and that South Creek Drive previously was vacated, limiting east–west access; he said his understanding is that CoAction would access off Grand Blvd and has not indicated a need for access to West Creek Drive.
Commissioner Stuart Allen moved for a favorable recommendation to the Common Council for Petition PC 26-21; Dave Vinzant seconded and the motion passed unanimously (8-0).
