Commission approves $600,000 USDA community forest grant agreement for Mus Bay Overlook acquisition

The commission voted to approve a USDA community forest grant agreement that will obligate $600,000 in federal funds toward acquisition of the Mus Bay Overlook property, a staff presentation said. The total acquisition cost is described in the materials as just over $1.2 million; the city increased its local share by roughly $21,000 to strengthen a matching/trust-fund application point.

Staff said the grant agreement designates the property to be managed as a community forest under U.S. Forest Service definitions — public property preserved for public use and managed to minimize harm while improving access and usability. As with other federal grants, the agreement contains standard boilerplate provisions including Buy America-like provisions and other federal certifications the city must accept to obligate funds.

One commissioner objected to a copyright and photography clause in the agreement (page eight, letter M in the packet), saying the language appeared overly broad and could raise first-amendment or tourism-sharing concerns if individuals or groups placed photos of the parcel online. The city attorney had reviewed the agreement and reported no items of substantive concern to be flagged for the commission, but commissioners asked staff to note the concern and proceed cautiously.

The commission approved the agreement by unanimous voice vote. Staff will proceed to execute the grant agreement and coordinate next steps for closing and property acquisition as outlined in the grant documents.
