Wardsville trustees say sewer, easement issues must be resolved before Route B rezoning petition

At a July 1 meeting, the Board of Trustees of the Village of Wardsville told Darrell and Doug Kolb that they must resolve sewer-service and easement issues before submitting a petition to rezone and split a parcel on Route B.
Board Chairman William (Bill) Gratz said there is "no sewer on the property, and no easement for it," and that the Kolbs would need to work out access with neighbor Gary Frank and with Missouri American Water before returning with a formal petition. Gratz also told the Kolbs that any rezoning would require approval by a majority of the property owners surrounding the parcel and that letters would need to be mailed to those neighbors.
Gary Frank and representatives from Missouri American Water participated in follow-up discussion about site utilities. Gary Frank reported a proposed swap of a storm drain with Missouri American Water and presented concerns about responsibility for future repairs. Byron Shaw of Missouri American Water reviewed drawings and said the utility "would put in writing if anything goes wrong with the pipes, the MO American water would repair." The Board said the swap and any related work should proceed only if the terms are put in writing and legal counsel signs off.
The Board did not vote on rezoning at the meeting; trustees described a series of preconditions the applicants must satisfy before the Board would accept a petition or schedule a public hearing. That process includes securing utility easements or connections, obtaining written commitments from Missouri American Water about pipe repairs, and demonstrating neighborhood support as required by the Board's procedures.
