Irvington council strengthens First Source hiring rules, adds reporting and penalties

The Irvington Municipal Council adopted amendments on Sept. 9 to Chapter 49 (First Source Employment Linkage Program), updating the township’s rules that require recipients of certain economic incentives to make good-faith efforts to hire qualified Irvington residents.
The ordinance names the Department of Economic Development Grants Oversight ("DEDGO") and the Office of Community Development and Planning ("CDP") as the intermediaries tasked with coordinating job referrals, and it requires recipients of defined economic incentives to submit a pre-hiring notification and observe an exclusivity period of at least 15 days so DEDGO/CDP can refer qualified Township residents. Economic incentives subject to the program include long-term tax exemptions, grants or loans of $25,000 or more, conveyances of township property valued at $25,000 or more, and township service contracts over $100,000.
The amendment requires semiannual reports to the administration and municipal council listing referrals, hires, ward of residence, wages and any findings of lack of good-faith. Where a recipient materially fails to make a good-faith effort, the ordinance establishes liquidated damages of $25,000 per worker hired in violation and preserves the township’s other remedies, including termination of incentives.
The ordinance also sets definitions (long-term job: 90 to 180 days or more) and monitoring provisions including record access and semiannual oversight conferences before the Redevelopment Committee. The council adopted the amendment as part of the consent/ordinance slate (record: Adopted; Absent: Cox).
