Council grants easement to Wil-Jac LLC to legalize Keelen’s outdoor patio encroachment

Keansburg’s council on Oct. 16 adopted Ordinance #1734 authorizing the conveyance of easement rights in a portion of the Wood Avenue paper right-of-way to Wil-Jac, LLC so the existing outdoor patio of Keelen’s Bar & Grill may remain in place.
The ordinance states the Wood Avenue right-of-way is a paper street not currently used by the borough and that Wil-Jac (Block 162, Lot 14) requested an easement for an approximately 1,598.37-square-foot area shown on a proposed plat and metes-and-bounds description prepared for the property. The borough agreed to grant the easement provided Wil-Jac indemnifies and defends the borough from claims arising from use, carries adequate insurance and executes any necessary easement documents approved by borough counsel and manager.
The council opened the public hearing for the ordinance but recorded no public speakers and subsequently adopted the ordinance by roll call during the meeting. The ordinance directs the mayor and borough clerk to execute implementing documents in forms acceptable to borough management and special counsel.
