Keansburg introduces comprehensive stormwater ordinance for major development

Keansburg’s council introduced Ordinance No. 1731 on Sept. 18 to create a municipal Stormwater Control chapter that implements performance standards for major development, including groundwater recharge, stormwater-runoff quality (80% TSS removal for regulated motor-vehicle surfaces), quantity controls, green-infrastructure Best Management Practices (BMPs), and maintenance and deed-notice requirements.
The proposed chapter incorporates and references the New Jersey Stormwater Best Management Practices Manual and the Department’s rules (N.J.A.C. 7:8). It defines major development thresholds (for example, disturbance of one or more acres or creation of one-quarter acre of regulated impervious surface), describes allowable BMPs and their contributory drainage-area limits, and requires a maintenance plan with recordings on deed where a non-public party is responsible for long-term upkeep. Penalties for violation are set (fine not to exceed $2,000). The ordinance also lists technical calculation methods (NRCS/TR-55, NJ Geological Survey GSR-32) and specifies required submissions for site development stormwater plans.
The council introduced the ordinance and scheduled a public hearing Oct. 16, 2024. If adopted, projects meeting the ordinance’s definition of major development would be required to meet the new design, performance and maintenance standards and to provide long-term maintenance assurances recorded on deed.
