The Borough of Keansburg on Jan. 29 adopted a binding resolution accepting the Department of Community Affairs’ Round 4 estimates for affordable housing obligations while explicitly reserving the right to contest those figures.
The resolution, adopted as Resolution 25-013, commits the borough to a DCA-present need (rehabilitation) of 91 units and a prospective (new construction) need of 31 units as the DCA reported in October 2024. The resolution also instructs the borough’s Affordable Housing Counsel to file a declaratory judgment complaint within 48 hours of adoption and to file the resolution with the Program required by P.L. 2024, c.2 (sometimes called “A4”).
The text of the resolution notes the borough may seek adjustments to those numbers based on a windshield survey, vacant-land or durational (sewer/water) adjustments, or “regional planning entity” inputs. It further reserves the borough’s rights to revoke or amend the commitment if there is a successful legal challenge to A4 or if subsequent legislation alters deadlines or requirements.
Council members did not debate the technical calculations in detail at the meeting; the resolution incorporates statutory language explaining the region-based method A4 uses to estimate need. The resolution directs counsel to file the required materials and to seek a certification of compliance while preserving any and all litigation rights.
Next steps: the resolution takes effect immediately, the council directed the filing of the declaratory action within 48 hours, and the borough will publish the resolution on its municipal website within 48 hours of passage as required by A4.
