Board deadlocks 4-4 on Vorandesoto/Xcel Energy rezoning; approves conditional interim use permit

The Silver Creek Township Board of Planning and Zoning failed to pass a rezoning request for a parcel tied to Vorandesoto and Xcel Energy on Aug. 5, 2025, leaving the zoning status unchanged after a 4-4 tie. Committee member Brandon Geyen moved to rezone the property to industrial; Ryan Nelson seconded and the motion resulted in a 4-4 vote and did not pass. Chairman Chris Klein subsequently moved to approve an interim use permit (IUP) with stated conditions that the board recorded as taking effect only if rezoning is later approved; that motion carried 8-0.
The IUP approved by the board was recorded with the following conditions in the minutes: minimal or no access to 148th; no overnight lighting unless motion controlled except at entrances; a stormwater plan approved by the agency abbreviated in the minutes as "wcsw"; a dust control plan; compliance with county traffic signage and requirements; and steps to mitigate backup-noise. The minutes do not expand the acronym "wcsw" or identify which department or agency that refers to; the board’s action notes the requirement as written in the minutes.
Board members divided over the parcel’s best long-term use. The minutes record that some members said the industrial use would cause minimal disturbance and that the site has been vacant for an extended period, while others said the location would be better suited to commercial development. The IUP approval was explicitly recorded as contingent on a future rezoning: the IUP "should the rezoning pass," per the minutes.
Because the rezoning motion failed on a tie, the IUP as approved by the board will not take effect unless and until the board later approves rezoning or another action changes the parcel’s zoning status.
